Terms and Conditions

General: Thank you for choosing Dickson Productions, Inc. Upon full payment of the tour price by the tour participant ("you" or "your") named in the Reservation Application agreement (application) Dickson Productions Incorporated, 6425 S. IH 35 Suite 150, PMB #293 in Austin, TX 78744-4230, (We, Us, Our or DP) agrees to provide the services specified in the accompanying advertising subject to the terms, conditions and limitations contained in this agreement. This agreement shall be effective when the Application is properly completed, signed and payments therein specified are received and accepted by us. If we do not receive your completed Application, We cannot include you on the tour. Neither You, representatives, nor Your travel agent may modify, add, or delete any terms of this agreement.

Payments: All checks are made only to Dickson Productions, Inc. or your certified travel agent. Final payments must be received on or before October 26, 2010. Any person that makes a reservation within 70 days of the beginning day of the trip must pay in full. We cannot be responsible for reservations when final payments are not received on time, in which, the cancellation policy will be in effect. All payments within 30 days prior to trip must be paid by cashiers check or money order. DP does not take responsibility for lost or delay in mailing. Do not mail cash. A $20.00 late sign-up fee will be added to the package price when DP receives reservations deposit after September 30, 2010. An additional $10.00 charge per week will be applied if you have not paid your final balance by the due date. All reservations are made on a first come, first serve basis.

Cancellation Policy: There is a $100 cancellation fee for all cancellations. No refunds will be given if cancellation is received after October 26, 2010. All cancellations must be made in writing including date and signature of person making the cancellation. Cancellation policy will be in effect if payments are not received on time or written cancellation notice is not received by DP. DP is not responsible for lost payments or delay in mailing. Cancellations by phone must be confirmed in writing by fax or mail within 3 days from the person that cancels. See Substitution for refund options.

Recording, Photography, or Video Taping: of activities during the entire D.P. MusicFest or SkiJam ski trip (or any D.P. event) including but not limited to all scheduled MusicFest performances and activities in venues, public areas, Steamboat Ski Resort, lodging properties, and any location deemed necessary for recording, photographing, or video taping may be conducted for future rebroadcast, advertising, or commercial purposes. By participating in the said trip and or entering any MusicFest venues or areas noted, you are consenting to these activities without payment or remuneration of any kind. D.P. does not offer or provide any surveillance or security cameras, video, or taping for any security issue whatsoever.

Refundable Incidental/Damages Deposit: A $25.00 per person refundable deposit is due with final payment. This deposit may be utilized at DP's discretion for any on-site or post trip assistance including, but not limited to, any disruptive activities that a DP representative must provide assistance. This deposit may not be refunded if the participant does not sign the terms and conditions agreement on or before the first day of the trip. Your deposit will be refunded within 90 days after trip, if there are no complications with your room, public areas, areas responsible by the ski group and if you have signed the terms and conditions agreement prior to the trip. Within 2 hours of check-in to your room, the occupants of the unit must complete and return the room condition form to the hotel management, condominium management, or DP. Before checking out, it is your responsibility to pay all room incidental charges.

Returned Checks: DP shall collect a $30.00 charge for any returned checks. The $30.00 returned check fee plus the original amount of the check must be paid to DP within 72 hours of your verbal or written notification by DP or your reservation will be canceled. Amount due must be paid by money order, cashierÕs check, or certified check.

Collection Cost: Participant agrees to pay reasonable attorneys fees and other expenses incurred by DP in the collection of unpaid damages, insufficient or stopped checks, credit card reversal or misrepresentation or other losses under this agreement if such collection is deemed necessary by DP.

Maximum Occupancy: Prices are based on maximum occupancy. Hotels or condos may include a queen sleeper sofa as part of the sleeping accommodations. For example: a 4 people condo may have 1 bedroom plus utilize a queen sleeper sofa in the living room.

Less Than Maximum Occupancy: If your unit (hotel or condominium room) is not filled to maximum occupancy due to cancellations or inability to fill vacant space(s) by trip participants, the remainder of the participants in the unit will be charged according to less than maximum prices and must be paid in full prior to checking into the unit by occupants of the unit.

Substitution: Original participant making the reservation is responsible for all financial settlement with the substitute. A $50.00 name change fee is required. The substitute must complete all reservation requirements, including those stated under the payments section, and be received by DP along with a written notice of a substitution from you. Substitute must agree to all terms and conditions.

Roommate Request: You choose your roommates, in which, a proper roommate request must be received on or before October 26, 2010 from each participant. In case of a conflicting roommate request, DP will assign roommates accordingly. Having people stay in your room that are not DP paid participants of the trip will result in you and all participants in the unit to be evicted from the trip in its entirety. Once evicted, you and all participants will not be refunded for any portion of the trip.

Participants Requested Changes: All requests for any changes that deviate from the advertised trip must be received in writing by DP. Such changes include, but are not limited to: all roommate changes, date changes, accommodations, and transportation. Changes are not applicable until approved in writing by DP. Up to a $50.00 fee may apply for changes.

Refunds: No refunds will be remunerated for any and all unused portions of the trip including transportation, rentals, accommodations, activities, unused lift tickets, rental vouchers, or optional items. Refunds may apply only where injury, illness or medical attention is required and prohibits the participant from skiing. Unused ski rentals and lift tickets prepaid to DP may be refunded when a written physician's statement of illness is received in the mail by DP by January 31, 2011. Included with the physician's statement, should be the lift and/or rental voucher. The lift and/or rental voucher must be in acceptable condition. Refunds will not be issued for used lift and/or rental vouchers. However, DP will attempt to seek a refund for any other unused lift tickets and/or unused rental vouchers with the ski corporation. The unused lift tickets and rental vouchers must be received by DP no later than January 31, 2011.

Flight Information: Airline and transfer restrictions are those of the company providing the services and you are responsible for these restrictions. DP and sponsoring representative(s) cannot accept responsibility for passengers' failure to verify flight times with the airline. When making connecting flights, allow adequate time for delays or changes in scheduling.

Participants' Conduct: Dickson Productions, law enforcement, and/or property management reserves the right to deny anyone to stay in the accommodations or to be involved with any activities or events at any time during the duration of the trip for any disciplinary problems that may harm or interfere with the enjoyment of other trip participants including, but not limited to, any type of destruction. There will be no refund of any moneys including, but not limited to, deposits, transportation, and rentals if any part of the participantsÕ conduct policy is violated.

Insurance: We highly recommend the purchase of comprehensive travel insurance plans for cancellation protection, personal liability, luggage insurance, accidental death/dismemberment, and medical coverage.

Trip Agenda and Procedures: DP and sponsoring representative(s) cannot accept responsibility for your failure to verify trip dates, time and location of check-in, check-out, all activities and events. Check-in procedures and information will be available on line at www.bigskitrip.com approximately 30 days before the trip unless noted otherwise. You may request a written version of this information by calling or writing DP. DP cannot be responsible for loss or delay in mail or incorrect address on your sign-up form. Event schedule will be available at check-in. Baggage/Luggage is at the owners' risk entirely.

Additional Hotel or Condo: Some properties (condominiums or hotels) may charge a daily or weekly fee or valet fee for a participant's vehicle. These fees are solely responsible by the participant. Some properties may not allow oversized vehicles or trailers including, but not limited to, bus, travel trailers, etc. Additional fees may include, but not be limited to, bellman luggage fees, room service etc. Contact property front desk or management for information.

Rentals: D.P. does not accept any ski or snowboard equipment liability. DP is only responsible for the equipment reservation. Any restrictions are those of the rental company. A cash or credit card deposit, at the discretion of the rental company, may apply when receiving equipment. Rental equipment insurance is available (and recommended) for an extra fee and available by the rental company.

Entertainment Portion of Trip: In the event of cancellation or any portion of the celebrity or entertainment package is not fulfilled; DP will not refund any portion of the trip package. Events, activities, and entertainment are subject to change without prior notice. Events are held in large and small capacity venues. Some venues may fill to capacity with only One Out-One In access.

Website Errors: While we have taken every precaution to insure accurate website prices, DP cannot guarantee the website to be free of pricing and description errors. D.P. reserves the right to correct and charge for such errors and discrepancies, if any.

Tour Agreement: DP and the sponsoring representative(s) are acting solely as agents. They are responsible for making the arrangements for all accommodations and services which constitute the trip, except to the extent that accommodations or services cannot be supplied due to reasons beyond control of the agents. The above parties are not in any way liable for personal injury, death, property damage or loss arising out of the act, omission or negligence of any direct air carrier, motor coach company, hotel or any person rendering any services or accommodations in conjunction with the tour. Furthermore, the above parties are not in any way responsible for any injury, damage or loss to reason of theft, accident, or any reason beyond control of those parties. As with most sports skiing, snowboarding and any activities associated with the ski resort adhere to personal risk which the participant assumes all liability. D.P. is not responsible for weather conditions. Refunds will not be given due to inclement weather.

By forwarding a deposit, the participant certifies that he/she does not have any mental, physical, or other conditions or disability whatsoever that would create a hazard or risk for him/herself or other participants.

Participants agree to adhere to all warnings and regulations stated by the Ski Corporation. DP and Co-sponsors reserve the right to use similar accommodations and services to the original ones sold, if the original property becomes unavailable for any reason. The operator will make no changes or alterations in the itinerary unless it appears to be in the best interest of the participant. You must be 18 years of age or older or supply written parental consent to participate on this trip. Any participant under the age of 18 must be accompanied by a legal guardian or parent at all times, for any and all activities, events, and concerts conducted by D.P.

DP reserves the right to use pictures and videos of participants for use in promotions of future trips. This terms and conditions agreement is accepted by payment in full for a reservation, placing a $100 deposit, and/or attendance and/or participation in any and all activities, events, and concerts.
